Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law. If you are a consumer in the European Union or the United Kingdom, you keep the mandatory rights given to you by the law of your country of residence.

11. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Subject to any mandatory consumer protection rules that apply to you, the state and federal courts located in Delaware have exclusive jurisdiction, and you consent to their jurisdiction. To the extent permitted by law, any claim must be brought individually and not as a plaintiff or class member in any purported class or representative proceeding, and must be brought within one year after the claim arose.

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or to a successor of the Site. These Terms, together with the documents they refer to, are the entire agreement between you and us about the Site.
